Shipping and Forwarding Terms and Conditions
1. General Provisions
These Terms and Conditions outline the fundamental rights and obligations concerning freight forwarding services in various international modes of transport within the logistics process. They shall be the reference for the Parties during negotiations and dispute resolution.
2. Description of the goods
The goods include aluminum profiles, could be protected by cartons or not and wrapped in stretch films or not, then bundled together.
Each bundle is further safeguarded by four or less wooden frames. These bundles are placed on two trolleys, one trolly or without a trolly within each container.
Each trolley is secured with two belt straps equipped with ratchet mechanisms or any other security method.
The trolleys themselves are constructed from rigid material that will withhold the weight.
To ensure the security of the goods on each trolley, four vertical and two horizontal steel bars are employed if needed.
3. Representations and Warranties by the “Shipping Agent”
The Shipping Agent holds the responsibility of organizing and executing the safe movement of goods to their final destination.
It is the Shipping Agent’s duty to provide proper protection for the aluminum profiles against weather conditions, fire hazards, theft, and all other risks.
The Shipping Agent acknowledges that the packaging is non waterproof and must handle, deliver and store the aluminum profiles under a covered roof in a clean and dry environment, free from any potential chemical interactions or causes of corrosion.
The Shipping Agent is obliged to review and maintain all necessary documents, including valid cargo insurance, warehousing arrangements, shipment schedules, and cargo tracking.
Throughout the term of these Terms and Conditions, the Shipping Agent must maintain insurance policies in compliance with CANEX’s insurance requirements and provide CANEX with a copy of those policies.
The Shipping Agent must promptly deliver to CANEX, upon request, certificates of insurance from the relevant insurer, indicating the effectiveness of the insurance coverages. They should also provide at least thirty (30) days’ written notice to CANEX in the event of intending to cancel or materially modify any insurance policy.
In the case of any deviation from the established process or any incident involving any type of risk on the goods, the Shipping Agent must immediately (within 24 hours) report the matter and share supporting media, such as photos and videos
4. Storage Conditions
The following conditions should be respected when storing aluminum products to avoid possible damage and corrosion. Any defects that arise due to improper storage conditions will be the Forwarding/Shipping Agent responsibility:
While transporting the aluminum products, and to prevent any friction, the agent should take into consideration the weight and check for any overload.
The Products shall not be stored under the rain, snow, strong wind, or other harsh weather conditions as this may result in the corrosion of the products and will not be covered under warranty.
All aluminum products must be stored in a clean and dry environment, and free from any chemical interaction whenever possible. Such products must be stored indoors and should be covered at all times.
Temperature and humidity variations within the warehouse should be kept to a minimum. All stock must be kept constant over the dew point temperature.
To avoid ground contact, all stocks must be reserved on wooden or metal pallets at all times.
It is prohibited to store aluminum material outdoors at all times. In the case of the outdoor storage of the products, CANEX will not be responsible for any damage caused to the products.
Moreover, it is also strongly advised to take into consideration the below measures:
A simple frame could be installed around the bundles by covering them with a waterproof film, tarpaulin, or similar material.
A reasonable space should be kept between the bundles and the waterproof cap to allow free air circulation.
It is recommended to store the bundles at a slight inclination without any contact with the ground to allow the rain to drain away from the stock.
The stock area should be kept under surveillance to check for any possible wetness in the material.
Regardless of the material’s position of storage (stored at the bottom, top, or center of a bundle), there is always a high chance that they might get wet since condensation of water could not always be inevitable and water may not always flow away.
5. Terms and Conditions Review
These terms and conditions are subject to periodic review and may be updated without notice to the agent. Both parties agree to the updated terms for ongoing orders.
